General Terms and Conditions of Sale

. 1 General provisions

The user, by browsing this section, accesses FintexGroup (info@fintexgroup.it). Browsing and submitting a purchase order on the site implies acceptance of the Terms and the Data Protection Policies adopted by the site itself, as indicated therein.

These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site www.fintexgroup.it in accordance with the provisions of Part III, Title III, Chapter I, of the Italian Consumer Code (Legislative Decree no. 206/05 as amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by:

The user is required, before accessing the products offered by the site, to read these General Terms and Conditions of Sale, which are considered generally and unequivocally accepted at the time of purchase.

The user is invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, whose terms fintexgroup reserves the right to modify unilaterally and without notice.

It is possible to use the site and therefore access the products offered by it and purchase them, in the following languages:

. 2 Purpose

These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on fintexgroup, and do not govern, on the other hand, the provision of services or the sale of products by parties other than the seller who are present on the same site through links, banners or other hyperlinks.

Before submitting orders and purchasing products and services from different parties, we suggest verifying their own conditions of sale.

. 3 Conclusion of the contract

To conclude the purchase contract, it will be necessary to fill out the form: Buy in electronic format and send it following the corresponding instructions.

This includes reference to the General Terms and Conditions of Sale, the images of each product and its price, the payment methods that can be used, the delivery methods of the purchased products and the corresponding shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and timeframes for returning purchased products.

Before concluding the contract, it will be requested to confirm reading of the General Terms and Conditions of Sale, including the Information on the right of withdrawal and the processing of personal data.

The contract is concluded when the seller receives the products, after verifying the accuracy of the data contained therein.

The buyer will be obliged to pay the price from the moment the online order submission procedure is completed. This will occur by clicking the button: Buy at the end of the guided process.

Once the contract is concluded, the seller takes charge of the order for processing.

. 4 Registered users

By completing the registration procedures, the user undertakes to follow the indications present on the site and to provide their personal data correctly and truthfully.

Confirmation must be communicated within a maximum of 10 days, after which, in the absence of confirmation, fintexgroup will be released from any commitment towards the user.

Confirmation will in any case release fintexgroup from any liability regarding the data provided by the user. The user undertakes to promptly inform fintexgroup of any variation of their own data communicated at any time.

In the event that the user communicates inaccurate or incomplete data, or even in the event of a claim by the interested parties regarding payments made, fintexgroup will have the right not to activate or to suspend the service until such deficiencies are remedied.

On the occasion of the first request for activation of a profile by the user, fintexgroup will assign a username and password. The latter acknowledges that these identifiers constitute the validation system for the user's access to the Services and the only system suitable for identifying the user, so that acts performed through this access will be attributed to them and will have binding effect against them.

The user undertakes to keep their access data secret and to keep them with due diligence, and not to transfer them, even temporarily, to third parties.

. 5 Availability of products

The availability of products refers to the actual availability at the time the buyer places the order. This availability must in any case be considered purely indicative, as, due to the simultaneous presence on the site of multiple users, products could be sold to other customers before the order is confirmed.

Even after sending the order confirmation email, cases of partial or total unavailability of the goods could occur. In this case, the order will be automatically corrected by removing the unavailable product, and the buyer will be informed immediately by email.

If the buyer requests cancellation of the order, terminating the contract, fintexgroup will refund the amount paid within 30 days from the moment fintexgroup becomes aware of the buyer's decision to terminate the contract.

. 8 Payment methods and prices

The price of the products will be the one indicated at any time on the site, except in the case of a manifest error.

In case of error, fintexgroup will notify the buyer as soon as possible, allowing them to confirm the order at the correct amount or cancel it. In no case will fintexgroup be obliged to supply the item sold at the lower price indicated by error.

The prices on the site include VAT and, in some cases, include shipping costs when indicated. Prices may change at any time. Changes do not affect orders for which order confirmation has already been sent.

Once products are selected, they will be added to the cart. It will be sufficient to follow the instructions for the purchase, entering or verifying the information requested at each step of the process. Order details may be modified before payment.

Payment can be made using the following method: PayPal, Credit Card, Prepaid Cards, Postepay, Cash on Delivery, Klarna (for payments in 3 installments) or Bank Transfer.

. 9 Delivery

Fintexgroup ships to the following geographic areas: Italy and the rest of Europe

Delivery takes place within the date indicated therein; if no delivery date is specified, within the estimated timeframe at the time of selecting the delivery method and, in any case, within a maximum period of 3 days from the confirmation date.

If it is not possible to make the delivery, the order will be sent to the warehouse. In that case, a notice will indicate the location of the order and the methods for arranging a new delivery.

If you cannot be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.

If delivery cannot be made for reasons not attributable to us within 10 days of the date on which the order is available for delivery, we will understand that you wish to terminate the contract.

As a consequence of the termination, the amounts will be refunded, including delivery costs, excluding any additional costs arising from the choice of a delivery method other than the standard method offered, without undue delay and, in any case, within 14 days from the date of termination of the contract. Transport arising from the termination of the contract could have additional costs to be borne by the buyer.

Shipping costs are borne by the buyer and are explicitly indicated when placing the order.

. 10 Transfer of risk

The risks relating to the products will be borne by the buyer from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in respect thereof, including shipping costs, is received, or at the time of delivery, if this occurs at a later time.

. 11 Warranty and commercial conformity

The seller is responsible for any defect in the products offered on the site, including lack of conformity of the items with the products ordered, in accordance with the provisions of Italian regulations.

If the buyer has entered into the contract as a consumer, that is, any natural person acting on the site for purposes unrelated to any business or professional activity they may carry out, this warranty is valid provided that the defect appears within 24 months from the date of delivery of the products; that the buyer submits a formal claim regarding the defects within a maximum of 2 months from the date on which they became aware of the defect; and that the online return form is correctly filled out.

In the event of lack of conformity, the buyer who has entered into the contract as a consumer will have the right to obtain the restoration of conformity of the products free of charge, through repair or replacement, or to obtain an appropriate price reduction

or the termination of the contract in relation to the goods claimed and the consequent refund of the price.

All costs of returning defective products will be borne by the seller.

. 12 Withdrawal

In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without any penalty and without having to specify the reason, within 14 days pursuant to art. 57 of Legislative Decree 206/2005, starting from the date of receipt of the products.

In the case of multiple purchases made by the buyer in a single order and delivered separately, the 30-day period begins to run from the date of receipt of the last product.

The buyer wishing to exercise the right of withdrawal must communicate this to fintexgroup by means of an explicit declaration, which can be sent by registered mail with acknowledgment of receipt or by accessing the section: Contact us on the site, by opening a request.

The buyer must exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract, or alternatively by submitting the standard withdrawal form, provided for in Annex I, part B, of Legislative Decree 21/2014, not mandatory.

The goods may be returned at any fintexgroup point of sale present on Italian territory, as well as sent to:

The goods must be returned intact, in their original packaging, complete in all their parts and with the corresponding fiscal documentation attached. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum of 30 days, including any shipping costs.

In accordance with the provisions of art. 56, paragraph 3, of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the site may suspend the refund until the goods are received or until the buyer demonstrates having sent them back.

The site will make the refund using the same payment method chosen by the buyer at the time of purchase. In case of payment by bank transfer, and if the buyer wishes to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT and BIC necessary to make the refund.

. 13 Data processing

The buyer's data is processed in accordance with the provisions of the regulations on the protection of personal data, as specified in the corresponding section containing the information pursuant to art. 13 of Legislative Decree of June 30, 2003 (Privacy Policy).

. 14 Severability clause

In the event that any of the clauses of these General Terms and Conditions of Sale is null for any reason, this will in no way compromise the validity and enforcement of the other provisions contained in these General Terms and Conditions of Sale.

. 16 Applicable law and competent jurisdiction

These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any different mandatory rule that may prevail in the country of habitual residence of the buyer. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale are subject exclusively to Italian legislation, and any dispute related to and/or arising from them must be resolved exclusively by the Italian judicial authority. In particular, if the buyer has the status of Consumer, any disputes must be resolved by the court of the place of domicile or residence of the buyer, in accordance with applicable legislation.
